These Terms & Conditions ("Terms") govern your access to and use of the website located at powerworkforcellc.com (the "Site") and any related recruiting, application, or communication services offered by Power Work Force LLC ("Power Work Force," "PWF," "we," "us," or "our"). By accessing or using the Site, or by submitting an application or inquiry to us, you agree to be bound by these Terms.
1. Who We Are
Power Work Force LLC is a workforce staffing and mobilization company providing skilled labor for solar, natural gas, battery energy storage (BESS), and AI data center construction projects across the United States.
2. Eligibility
You must be at least 18 years old to use the Site or submit an application to Power Work Force. By using the Site or applying for a position, you represent that you meet this requirement and, where applicable, that you are legally authorized to work in the United States.
3. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
● Provide false, inaccurate, or misleading information in any application or communication.
● Use the Site in any way that could damage, disable, or impair its operation.
● Attempt to gain unauthorized access to any part of the Site, our systems, or related accounts.
● Use automated means (bots, scrapers) to access or collect data from the Site without our prior written consent.
● Use the Site to transmit any unlawful, harassing, defamatory, or otherwise objectionable content.
4. Job Applications and Recruiting Process
Submitting an application, resume, or inquiry through the Site, Indeed, WhatsApp, or any other channel does not guarantee an interview, job offer, or placement. Power Work Force evaluates candidates at its sole discretion based on project needs, qualifications, and other factors.
If placed on a project, your employment or engagement will be governed by separate agreements and policies applicable to that placement, which may include performance evaluations conducted through our internal POWER Code review process.
5. Communications Consent
By providing your phone number or email address, you consent to receive communications from Power Work Force related to your application, placement, scheduling, and performance, including by phone, email, text message (SMS), and WhatsApp, subject to the consent and opt-out terms described in our Privacy Policy.
6. Intellectual Property
All content on the Site, including text, graphics, logos, and images, is the property of Power Work Force LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written consent.
7. Third-Party Links and Services
The Site may contain links to third-party websites or services (such as Indeed or WhatsApp) that are not owned or controlled by Power Work Force. We are not responsible for the content, privacy practices, or terms of any third-party website or service. Your use of third-party services is governed by their own terms and policies.

9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, POWER WORK FORCE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THESE TERMS.
10. Indemnification
You agree to indemnify and hold harmless Power Work Force LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or misuse of the Site.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the state or federal courts located in Texas.
